These Terms and Conditions applies to business relationships between Unz Unz AB, Malmö, Sweden, (hereinafter referred to as “Unz Unz”) and the Customer. The Customer are businesses or consumers. These Terms and Conditions applies equally to consumers and businesses (jointly referred to as’Customer/).

These terms and conditions are subject to Swedish and EU law and in the event of any conflict, the laws take precedence.

The display of Products in the online store do not constitute legally binding offers. By clicking ‘Buy’, the Customer makes a legally binding commitment to purchase the goods in the shopping basket. The Customer shall receive an order confirmation after that the order has been submitted. The sales contract enters into effect when the Customer receives an order-confirmation. The contract is stored, and the order data and Terms and Conditions are sent to the Customer by email. The Customer can view all previous orders by logging into the Customer service pages of the website.

Unz Unz reserves the right to refuse to perform the service promised if it becomes apparent after concluding the contract that the goods are not available. In such a case, the Customer will be notified immediately and, if payment has been made, be reimbursed without delay. Further claims in such a case against Unz Unz are without validity.

The Customer is obliged to keep login name and password secure together with any other user credentials. This includes not to share this information with any other third parties.

Unz Unz reserves the right to deny orders placed by a Customer that is under 18-years of age.

The contractual language is English.

These terms and conditions may be subject to change due to changed legislation or for any other business related reason that Unz Unz sees fit.


Delivery

The risk of accidental loss and accidental deterioration of the sold goods passes on to the Customer upon handover of the item, even in cases of sales involving the carriage of goods. Handover is deemed to have taken place even if the buyer delays in accepting the goods. Delivery will be made to the delivery address as specified by the Customer.

Prices

Prices are shown including VAT, if nothing other is clearly stated. Depending on the tax rules of the Customer’s country, VAT may be added or be payable at the Customer’s local customs office. Within Europe VAT, for each country, is calculated automatically.

Warranty and compensation

Defects or any other damage caused by negligent or improper treatment of the goods, improper installation, the use of unsuitable accessories or changes made to the original parts by the Customer or a third party not commissioned by Unz Unz are not covered by the warranty.

Signs of wear and tear from normal use are also excluded from the warranty. If the Customer accepts the goods or the object of the order despite being aware of a defect, the Customer shall only be entitled to assert warranty claims to the extent described below if the Customer has expressly reserved the right hereto in writing immediately after receiving the goods.

Warranty claims on the grounds of transportation damage may only be asserted by the Customer if the obligation to inspect and report has been fulfilled. This does not apply if the Customer is a consumer.

The warranty period for new items shall be 12 months, unless otherwise stated. The period shall commence upon transfer of risk. Warranty formalities shall otherwise be carried out in congruence with the legal regulations.


Unz Unz guarantee

Unz Unz shall also provide a three-year guarantee in accordance with the following provisions:

Unz Unz provides a guarantee for any defects arising during a period of three years from the transfer of the risk which can be proven to have been caused due to a material deficiency or a manufacturing error. The Customer can assert claims under the guarantee.

The following are excluded from the guarantee:

• Used equipment.
• Computer parts and accessories, unless otherwise specified in the respective item description.
• Products subject to wear through use or other wear and tear.
• Product defects caused as a result of failure to follow the instructions for use or of inappropriate use, exceptional environmental conditions, extraneous operating conditions, excessive strain or a lack of maintenance or care.
• Product defects caused by the use of accessories or supplementary or replacement parts which are not original components.
• Products which have been modified or supplemented.
• Slight deviations from the intended state which do not significantly affect the product’s value or its suitability for use.
  
  

Product defects which are recognised by Unz Unz as being subject to the guarantee obligation shall be remedied as follows: at our discretion, the defective product shall either be repaired free of charge or replaced with a fully functional product (a subsequent model if necessary). Products and components which have been replaced shall become the property of Unz Unz. Guarantee claims must be asserted within the official guarantee period. In order to do so, the product in question must be returned to Unz Unz with the original invoice by requesting a “free-return coupon”.

Claims other than the right to remedy defects referred to in these terms and conditions of guarantee are not covered by this guarantee.

The guarantee period for the product shall neither be extended nor renewed as a result of the provision of services under the guarantee.

The Customer’s warranty rights in accordance with statutory regulations shall not be restricted by these terms and conditions of guarantee.


Due date and payment terms

Unless otherwise agreed in writing, invoices from Unz Unz must be paid in full without delay.. Orders paid in advance will be shipped upon receipt of payment. For payments by credit card, the actual sum shall be debited when the invoice is issued and the goods are shipped. The total amount shall be reserved on the Customer’s credit card as soon as the online order is submitted. The Customer may chooses one of several payment options in Unz Unz webshop.

Unz Unz reserves the right to decline cheques and other non-cash means of payment. Foreign currency payments shall be credited according to our bank statement. Any bank fees must be borne by the Customer.

If the Customer falls into default on the payment of the purchase price, late payment interest is to be paid on the total purchase in accordance with applicable laws. If Unz Unz is able to prove that greater damages were suffered as a result of the default, Unz Unz shall be entitled to assert the corresponding claims on these grounds.


Retention of title

Unz Unz reserves the right of retention for the goods until the purchase price has been paid in full.

The Customer shall not be entitled to sell the goods to third parties or to take any other measures which could put the ownership of Unz Unz at risk until the purchase price has been paid in full.


Place of fulfilment and jurisdiction

The laws of Sweden shall apply together with applicable European Union laws. The place of fulfilment for all services and products arising from business transactions with Unz Unz shall be at the place of business of Unz Unz in Malmö, Sweden.

These terms and conditions as well as all disputes or claims arising hereof shall be governed and construed by the laws of Sweden together with applicable European Union laws and settled within the Swedish general court system.

If any of these provisions cannot be applied for whatever reason, this shall not affect the validity of the remaining provisions.


Liability

Unz Unz is not liable for loss of business or income under any circumstances.

Unz Unz will keep the details of the Customer’s order and payment secure, in the absence of negligence on the Unz Unz’s part, Unz Unz cannot be held liable for any loss the Customer may suffer if a third party procures unauthorised access to any data the Customer provides when accessing or ordering from Unz Unz’s Websites.

Unz Unz is not responsible or liable for the accuracy of the information provided to Unz Unz by third parties and is not responsible for any third party's policies or practices.

Unz Unz is not liable for any non-intended consequences that might occur if the Customer is in breach with these Terms and Conditions.

Giveaways

Only a EU citizen residing in a EU country are eligible for participating in giveaways. Selections of winners are done from a participation pool at the end of the giveaway. Selected winners are contacted via Facebook or Instagram. The winner is required to provide address and info within three business days from initial contact from Unz Unz. Another winner will be selected, if the winner fails to provide the requested information within the allotted time. Winners are liable for any potential taxation that is required to be paid in their EU country of residence.
